These terms are an agreement between you and OVERSAPIENS Co., Ltd. ("we").

When you tap "I'm 16 or older, and I agree" on the consent screen shown before you first use the app, you also agree to these terms. That screen shows what goes where, together with links to these terms, the Privacy Policy and the Health Data Notice. These terms also apply when you use oversapiens.com.

If you do not agree, you cannot use the app. If these terms change, we tell you in the app and on this page before the change applies, and if a change is against your interest we ask for your agreement again.

이 약관은 이용자와 주식회사 오버사피엔스(이하 「우리」) 사이의 약속이에요.

앱을 처음 쓸 때 보여 드리는 동의 화면에서 「만 16세 이상이고, 동의해요」를 누르면 이 약관에도 동의한 거예요. 그 화면은 무엇이 어디로 가는지와 함께 이 약관·개인정보 처리방침·건강 데이터 안내 링크를 보여 드려요. 웹사이트 oversapiens.com을 이용할 때도 이 약관이 적용돼요.

동의하지 않으면 앱을 쓸 수 없어요. 약관이 바뀌면 바뀌기 전에 앱과 이 페이지에 알리고, 이용자에게 불리하게 바뀌는 내용이면 다시 동의를 받아요.

Oversapiens is a personal assistant provided through the iPhone app (including its widgets and extensions) and oversapiens.com. It helps you plan your time and follow through, and keep records of your sleep, meals, training, body, mind and notes.

Oversapiens is a service that runs on generative AI. Answers, summaries, suggestions and screen judgements in the app are produced by generative AI (see "Use of AI").

It is a personal organisation tool. It is not a medical device and does not provide medical advice, diagnosis or treatment. Do not use it in place of professional care, and talk to a qualified professional about any health concern.

오버사피엔스는 아이폰 앱(위젯·확장 포함)과 oversapiens.com으로 제공하는 개인 어시스턴트예요. 시간을 계획하고 지켜 내도록 돕고, 수면·식사·운동·몸·마음·노트 기록을 관리하도록 도와요.

오버사피엔스는 생성형 AI를 이용해 운영되는 서비스예요. 앱의 답·요약·제안·판정 글은 생성형 AI가 만들어요(자세한 내용은 「AI 사용」 절).

오버사피엔스는 개인 정리 도구예요. 의료기기가 아니고, 의학적 조언이나 진단이나 치료를 제공하지 않아요. 전문적인 진료를 대신해 쓰지 말고, 건강 문제는 자격 있는 전문가와 상의해 주세요.

• Answers, summaries, suggestions and screen judgements in Oversapiens are produced by generative AI. Answers in the AI bar appear with the AI's name, such as "Oversapiens One".
• AI can be wrong. Check anything important yourself — health, money, legal or safety matters. In an emergency, contact your country's emergency number.
• The AI reads the records you can see in the app alongside you when it answers. What goes where, and how to switch it off, is in section 4 of the Privacy Policy.
• If you share AI-written text outside the app, please say that it was written by AI.
• If an AI answer is inappropriate, tap "Report" under it. An email filled in with the question and answer opens, and you check it before sending.

• 오버사피엔스의 답·요약·제안·판정 글은 생성형 AI가 만들어요. AI 바의 답은 「Oversapiens One」 같은 AI 이름과 함께 보여요.
• AI는 틀릴 수 있어요. 건강·돈·법·안전처럼 중요한 일은 직접 확인해 주세요. 위급한 상황이면 그 나라의 긴급 번호로 연락해 주세요.
• AI는 앱에서 보이는 내 기록을 같이 보고 답해요. 무엇이 어디로 가는지와 끄는 법은 개인정보 처리방침 4절에 있어요.
• AI가 만든 글을 앱 밖으로 공유할 때는 AI가 만든 글이라는 사실을 함께 밝혀 주세요.
• AI 답이 부적절하면 답 아래 「신고」로 알려 주세요. 질문과 답을 채운 메일이 열리고, 내용을 보고 보내면 돼요.

You use Oversapiens by signing in with your Apple Account. You are responsible for keeping access to it secure and for what happens under it.

You must be at least 16 years old. If your country sets a higher minimum age, you must meet that one.

You can delete your account in the app at any time — Settings › Account › Delete account.

오버사피엔스는 애플 계정으로 로그인해서 써요. 계정 접근을 안전하게 지키고 그 계정에서 일어나는 일을 책임지는 것은 이용자예요.

만 16세 이상만 쓸 수 있어요. 사는 나라가 정한 최소 나이가 더 높으면 그 나이 이상이어야 해요.

계정은 앱에서 언제든 지울 수 있어요 — 설정 › 계정 › 계정 삭제.

Some features are free. The free plan has a usage limit, and an ad may appear under an AI answer (see "Advertising"). Paid plans are billed through Apple as auto-renewing subscriptions and renew unless cancelled at least 24 hours before the period ends. Paid plans have no ads. If you want to go beyond your limit, you can buy "Additional usage" separately.

• Change or cancel in your Apple Account settings — we cannot do it for you.
• Refunds are handled by Apple under its policy. Only if you have turned on refund-review sharing on the purchase screen or in Settings › Privacy, when Apple asks during a refund review we tell it how much you used that purchase and whether it was delivered properly. It starts off, and paying and using the app work the same without it (Privacy Policy, section 13).
• Cancelling stops paid features at the end of the paid period; nothing you wrote is deleted.

If we change prices we will tell you before the change applies to you, and you can cancel before it does.

무료로 쓸 수 있는 기능이 있어요. 무료 등급에는 사용량 한도가 있고, AI 답 아래에 광고가 붙을 수 있어요(「광고」 절). 유료 요금은 애플이 자동 갱신 구독으로 청구하고, 기간이 끝나기 최소 24시간 전에 해지하지 않으면 갱신돼요. 유료 등급에는 광고가 없어요. 한도를 넘겨 쓰고 싶으면 「추가 사용량」을 따로 살 수 있어요.

• 변경과 해지는 애플 계정 설정에서 해요. 우리가 대신 해 드릴 수 없어요.
• 환불은 애플이 자기 정책에 따라 처리해요. 결제 화면이나 설정 › 프라이버시에서 「환불 심사에 사용 정도 알리기」를 켠 이용자에 한해, 애플이 환불을 심사하며 물으면 우리가 그 구매를 얼마나 썼는지와 제대로 받았는지를 알려 줘요. 처음엔 꺼져 있고, 켜지 않아도 결제·이용은 그대로예요(개인정보 처리방침 13절).
• 해지하면 낸 기간이 끝날 때 유료 기능이 멈춰요. 써 둔 것은 지워지지 않아요.

가격을 바꾸면 이용자에게 적용되기 전에 알리고, 적용되기 전에 해지할 수 있어요.

• While you use the free plan, one text ad labelled "Ad" may appear under an AI answer. Our server decides whether an ad is requested.
• To choose an ad we send the ad company words taken from this question, your country and your language. Cloudflare, which runs our server, may attach your connection IP address. We never place ads on conversations about body or mind, and never use health records for ads. Details are in section 7 of the Privacy Policy.
• In the ad's "···" menu you can see the values used to choose it ("Why am I seeing this ad"), close it ("Hide ad") and report an inappropriate ad ("Report ad").
• The content of an ad, and the products or services it links to, are the advertiser's responsibility. Sites you open from an ad are governed by their own terms.

• 무료로 쓰는 동안 AI 답 아래에 「광고」라고 표시된 글 광고 한 장이 붙을 수 있어요. 광고를 붙일지는 우리 서버가 정해요.
• 광고를 고르려고 우리가 광고 회사에 보내는 것은 이번 질문에서 뽑은 낱말·나라·언어예요. 서버를 운영하는 Cloudflare가 접속 IP 주소를 함께 붙일 수 있어요. 몸·마음 이야기에는 광고를 붙이지 않고, 건강 기록은 광고에 쓰지 않아요. 자세한 내용은 개인정보 처리방침 7절에 있어요.
• 광고 모서리의 「···」에서 「왜 이 광고가 보이나요」로 광고를 고른 값을 보고, 「광고 숨기기」로 닫고, 「광고 신고」로 부적절한 광고를 알릴 수 있어요.
• 광고의 내용과 광고로 연결된 상품·서비스는 광고주의 책임이에요. 광고를 눌러 여는 사이트는 그 사이트의 약관을 따라요.

Everything you write stays yours. We claim no ownership of your notes, records or plans.

You give us permission to use them only as far as needed to run the service for you — storing records on your device, encrypting and syncing them between your devices on the same account once you sign in, and sending them to an AI company to produce answers when you use the AI. Sync records are encrypted, so we cannot read them. We do not train AI on your records.

You are free to use the text, summaries and tidy-ups the AI makes for you.

이용자가 쓴 것은 전부 이용자의 것이에요. 우리는 노트·기록·계획의 소유권을 주장하지 않아요.

이용자는 우리에게 서비스를 운영하는 데 필요한 만큼만 쓸 수 있는 권한을 줘요 — 기록을 기기에 저장하고, 로그인하면 암호화해 같은 계정의 기기끼리 동기화하고, AI를 쓸 때 답을 만들려고 AI 회사로 보내는 일이에요. 동기화 기록은 암호화돼 있어서 우리는 내용을 읽을 수 없어요. 우리는 이용자의 기록으로 AI를 학습시키지 않아요.

AI가 이용자를 위해 만든 글·요약·정리도 자유롭게 쓸 수 있어요.

When you hand a task to the AI in the in-app browser, it acts on your instruction, on your device, using your signed-in sessions. It can therefore send requests to sites on your behalf. It does not send them to sites you have locked.

You are responsible for what you ask it to do and for following the terms of any site it visits for you. Review consequential actions — payments, sending, deleting — before confirming them.

앱 안 브라우저에서 AI에게 일을 맡기면, AI는 이용자의 지시에 따라 이용자의 기기에서 이용자의 로그인 상태로 움직여요. 그래서 AI가 이용자 대신 사이트에 요청을 보낼 수 있어요. 이용자가 잠근 사이트에는 보내지 않아요.

무엇을 시키는지, 그리고 AI가 대신 방문하는 사이트의 약관을 지키는지는 이용자의 책임이에요. 결제·전송·삭제처럼 결과가 큰 동작은 확인하기 전에 살펴봐 주세요.

Oversapiens provides location-based services. This section sets out our commitments for them.

(2) What the service does

• Running: while you run we record distance, pace and route. The route stays on this device and in the Health app and, once you sign in, syncs encrypted between your devices on the same account.
• AI directions: if you ask for directions without giving a starting point, we use where you are now. The coordinates go to Apple Maps to work out distance and time; the AI (Baseten, United States, through the Oversapiens server) receives only distance and time, such as "1.2 km, about 15 minutes on foot to X".
• In-app browser: if a web page asks for your location, your iPhone asks you first. If you allow it, the location goes to that website; we do not receive it.

(3) Your rights and how to use them

• You can withdraw all or part of your consent to location use at any time — turning it off in iPhone Settings › Privacy & Security › Location Services › Oversapiens counts as withdrawing it, and the next time the app opens it immediately erases the location-use records (confirmation records) obtained from iPhone location. Running routes already recorded are removed from this device and from sync when you delete that run in the app; routes saved in the Health app can be deleted there.
• You can ask us to pause location use — turning it off in the settings above pauses it immediately (and, as above, erases the location-use records).
• You can see your records of location collection, use and provision at any time in the app under Settings › Privacy › Location use record. You can also ask to be told why and how your location information went anywhere else, and ask us to correct anything wrong — privacy@oversapiens.com · +82-10-7460-2235.
• People under 14 cannot use Oversapiens (see "Your account" — you must be 16 or older).

(4) Why and how long we keep records of location collection, use and provision, and personal location information

• Confirmation records: each time location is used (recording a run · saving a running route to the Health app · importing workout routes from the Health app · AI directions), the app automatically notes on your device when, for which feature, and where the location came from and went (never the location itself). The basis is Article 16(2) of Korea's Location Information Act and Article 6 of the Standard on Administrative and Technical Protection Measures for Location Information; they are kept for 6 months and then deleted (Article 6(5) of that Standard). If you withdraw consent (turn off location permission) they are erased at once (Location Information Act, Article 24(4)).
• Running routes: kept as your workout record, until you delete them, on the device, in the Health app and in encrypted sync.
• The starting coordinates for AI directions: not kept. They are used only to work out distance and time and then discarded. The distance and time sent to the AI stay on the Oversapiens server as answer text for 2 minutes and are then deleted (locked with a key the app provides).

(5) Notices of disclosure to third parties: we offer no service that shares your location with another person you designate, so there are no such notices.

오버사피엔스는 위치기반서비스를 제공해요. 이 절은 그 서비스에 관한 약속이에요.

② 서비스 내용

• 러닝 기록: 러닝할 때 거리·페이스·경로를 기록해요. 경로는 이 기기와 건강 앱에 남고, 로그인하면 암호화된 채 같은 계정의 기기끼리 동기화돼요.
• AI 길 찾기: 출발지를 말하지 않고 길을 물으면 지금 위치를 출발지로 써요. 좌표는 애플 지도에 보내 거리·시간을 계산하고, AI(오버사피엔스 서버를 거쳐 Baseten, 미국)에는 「○○까지 걸어서 1.2km · 약 15분」 같은 거리·시간만 가요.
• 앱 안 브라우저: 웹 페이지가 위치를 물으면 아이폰이 허락을 물어요. 허락하면 위치는 그 웹사이트로 가고, 우리는 받지 않아요.

③ 이용자의 권리와 행사하는 법

• 위치 이용 동의의 전부나 일부를 언제든 거둘 수 있어요 — 아이폰 설정 › 개인정보 보호 및 보안 › 위치 서비스 › 오버사피엔스에서 끄면 동의를 거둔 것으로 보고, 앱이 다음에 열릴 때 곧바로 아이폰 위치로 얻은 위치 사용 기록(확인자료)을 지워요. 이미 남은 러닝 경로는 앱에서 그 러닝 기록을 지우면 이 기기와 동기화 기록에서 함께 지워지고, 건강 앱에 남은 경로는 건강 앱에서 지울 수 있어요.
• 위치 이용을 잠시 멈추라고 요구할 수 있어요 — 위의 설정에서 끄면 바로 멈춰요(끄면 위 줄처럼 위치 사용 기록도 지워요).
• 내 위치정보 수집·이용·제공사실 확인자료는 앱의 설정 › 프라이버시 › 위치 사용 기록에서 언제든 볼 수 있어요. 위치정보가 다른 곳에 간 이유와 내용을 알려 달라고 요구하거나 틀린 것을 고쳐 달라고 할 수도 있어요 — privacy@oversapiens.com · +82-10-7460-2235.
• 만 14세 미만은 오버사피엔스를 쓸 수 없어요(「계정」 절 — 만 16세 이상).

④ 위치정보 수집·이용·제공사실 확인자료의 보유근거와 보유기간 · 개인위치정보를 두는 목적과 기간

• 확인자료: 위치를 쓸 때마다(러닝 기록 · 러닝 경로를 건강 앱에 저장 · 건강 앱의 운동 경로 가져오기 · AI 길 찾기) 언제·어떤 기능에·어디서 얻어 어디로 보냈는지를 이용자의 기기에 자동으로 적어요(위치정보는 적지 않아요). 근거는 위치정보법 제16조 제2항과 「위치정보의 관리적·기술적 보호조치 기준」 제6조이고, 6개월 두고 지워요(같은 기준 제6조 제5항). 동의를 거두면(위치 권한을 끄면) 곧바로 지워요(위치정보법 제24조 제4항).
• 러닝 경로: 이용자의 운동 기록으로 남기려고 둬요. 직접 지울 때까지 기기·건강 앱·암호화 동기화에 있어요.
• AI 길 찾기의 출발 좌표: 두지 않아요. 거리·시간을 계산하는 데만 쓰고 바로 버려요. AI에 간 거리·시간은 오버사피엔스 서버에 답 글로 2분 남았다가 지워져요(앱이 준 열쇠로 잠가 둬요).

⑤ 제3자 제공 통보: 이용자가 지정한 다른 사람에게 이용자의 위치를 알려 주는 서비스는 없어요. 그래서 제공 통보도 하지 않아요.

You can stop using the service and delete your account at any time — Settings › Account › Delete account. Deleting your account removes your account, sync and usage records from our server, disconnects Sign in with Apple, and erases the records on this device. Records the law requires us to keep (payment and supply records, 5 years) and the deletion marker remain as set out in section 14 of the Privacy Policy. Subscriptions must be cancelled separately in your Apple Account settings.

If you materially breach these terms we may suspend or end your access. Where it is reasonable, we will tell you first and give you a chance to fix it.

이용자는 언제든 사용을 멈추고 계정을 지울 수 있어요 — 설정 › 계정 › 계정 삭제. 계정을 지우면 서버의 계정·동기화·사용량 기록을 지우고, 애플 로그인 연결을 끊고, 이 기기의 기록을 지워요. 법이 보관하라고 정한 기록(결제·공급 기록 5년)과 삭제 표식은 개인정보 처리방침 14절대로 남아요. 구독은 애플 계정 설정에서 따로 해지해야 해요.

이용자가 이 약관을 중대하게 어기면 우리는 접근을 멈추거나 끝낼 수 있어요. 그럴 만한 경우에는 먼저 알리고 고칠 기회를 드려요.

How we handle personal information is set out in the Privacy Policy and the Health Data Notice. If those documents and these terms differ, the one more favourable to you applies.

개인정보를 어떻게 다루는지는 개인정보 처리방침과 건강 데이터 안내에 있어요. 이 두 문서와 이 약관이 다르면 이용자에게 유리한 쪽을 따라요.
